Third-Party Access System
The third-party access system for the fixed liquid hydrocarbon storage facilities operated by Terminales Canarios is structured and organized as follows:
- On its corporate website, www.tcanarios.com, the Company publishes, in accordance with CNMC recommendations, the following information, broken down by hydrocarbon group and geographic location:
- Nominal Capacity
- Usable Capacity
- Contracted Capacity
- Validity of Contracted Capacity
- Used Capacity
- Contractual Physical Congestions
- Any formal access request that is duly completed will be communicated to the CNMC within a maximum period of one month from receipt.
- Upon receipt of an access request, the feasibility of granting access will be evaluated — requesting additional or supplementary information from the applicant if necessary — based on the following criteria:
- Availability of uncontracted capacity
- Possibility of negotiating with current lessees for the potential reassignment of contracted capacities
- Assessment of the applicant’s quality, safety, and environmental protection standards, as well as their supply scheme and frequency, to evaluate the potential impact on Terminales Canarios’ operations and standards, and on the operations and traceability of stocks of current lessees, considering that the product is physically stored in a non-differentiated manner
- Verification that the applicant meets all required authorizations (petroleum operator, distributor, etc.) or any other applicable requirements to contract Terminales Canarios’ services, in terms of solvency, guarantees, and risk coverage
- Issuance of a positive or negative decision regarding the feasibility of the request. If denied, the applicant will be notified with justified reasoning. If approved, the applicant will be informed and must accept the applicable commercial conditions, including procedures, party obligations, tariffs, payment terms, responsibilities and guarantees, conflict resolution, product loss handling, contract duration, etc.
- Communication to the CNMC of the completion of the process, including the outcome of the request
